Equity Bank PayPal Withdraw Service Terms and Conditions
1. The Equity Bank-PayPal Withdraw Service
1.1 Through the Equity Bank-PayPal Withdraw Service, Kenyan residents are able to withdraw funds from their Kenyan PayPal account into their qualifying Equity Bank bank account ("Withdraw Service"). The specific transaction performed when using the Withdraw Service is referred to as a Withdraw Transaction.
1.2 The Withdraw Service is offered by Equity Bank (Kenya) Limited (“Equity Bank” or “we”).
1.3 These terms form the contract between the User (“Client” or “you” or “your”) using the Withdraw Service. Upon accessing the Withdraw Service, the User hereby acknowledges and accepts these terms.
2. Withdraw Services and Eligibility.
2.1.1 The Withdraw Service is exclusive to Equity Bank customers and is available to individual and business with an Equity Bank bank account, transactional accounts in Kenya Shillings (KES) or United States Dollar (USD) ,Euro (EUR) or British Pound (GBP) .
2.1.2 The Withdraw Service is not a remittance business or a money transfer service and the Personal Payment feature may not be used to remit funds to third parties.
2.1.3 We do not have any control over, and are not responsible or liable for, the products or services that are paid for with the Withdraw Service. We cannot ensure that a buyer or a Seller you are dealing with will actually complete the transaction.
2.1.4 The Withdraw Service is not a common carrier or public utility.
2.2.1 To be eligible to use the PayPal Services, you must be at least 18 years old and a resident of Kenya.
126.96.36.199 You must list your correct country of residence in your PayPal Account. This Agreement applies only to you are a resident of Kenya.
2.2.2 To use the Withdraw Service you must have a verified Kenyan PayPal account.

184.108.40.206 To verify a Kenyan PayPal account you must link a credit card to your Kenyan PayPal Account. Any banks debit or credit card can be used, excluding PIN based debit cards. Business credit cards must be open to transact internationally and online;
220.127.116.11 The PayPal verification process is a PayPal process and Equity Bank cannot intervene in this process;
18.104.22.168 You will not be able to use the Withdraw Service until your Kenyan PayPal account has been verified;
2.2.3 To provide the Withdraw Service we are legally obliged to identify and verify the Users and to report suspicious transactions that may arise;
22.214.171.124 If we are unable to identify and verify you, in accordance with prevailing legislation, you will not be able to make use of the Withdraw Service;
126.96.36.199 To be able to identify and verify you, you will be required to supply us with certain documentation from time to time, which we will verify before allowing you to make use of the Withdraw Service; and
188.8.131.52 We may suspend your use of the Withdraw Service if you are unable to provide us with the required documentation or if we are required to do so by prevailing legislation.
3. Your contact information.
3.1 It is your responsibility to keep your primary email address uptodate so that Equity Bank can communicate with you electronically. You understand and agree that if Equity Bank sends you an electronic communication (email) but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic communications, Equity Bank will be deemed to have provided the communication to you effectively. Please note that if you use a spam filter that blocks or re- routes emails from senders not listed in your email address book, you must add Equity Bank to your email address book so that you will be able to view the communications we send to you.
3.2 You can update your primary email address or street address at any time by logging into the PayPal website on www.paypal.com and visiting your Equity Bank Branch to inform Equity Bank on the said changes. If your email address becomes invalid such that electronic communications sent to you by Equity Bank are returned, Equity Bank may deem your Account to be inactive, and you will not be able to transact any activity using your Equity Bank bank account until we receive a valid, working primary email address from you.
4. Identity Verification.
4.1 You authorize Equity Bank,directly or through third parties,to make anyinquiries we consider necessary to validate your identity. This may include asking you for further information or documentation, requiring you to provide a taxpayer or national identification number, requiring you to take steps to confirm ownership of your email address or financial instruments, ordering a credit report or verifying your Information against third party databases or through other sources.
5.1 We may at our discretion,impose limits on the amount of Withdraws you can receive through the Withdraw Service.
6.1 The Withdraw Service is made available to you subject to your acceptance of these Withdraw Service Terms and Conditions, which must be read in conjunction with, and hereby incorporates by reference, our disclaimers and all our other Equity Bank terms and conditions which are incorporated herein.
6.2 These Withdraw Service Terms and Conditions and all the additional terms and conditions are jointly referred to as the "Agreement". If there is a conflict between these Withdraw Service Terms and Conditions and the other terms and conditions specified in 7.1, then the provisions of these Withdraw Service Terms and Conditions will prevail to the extent of the inconsistency.

6.4 By using the Withdraw Service you accept and agree to all the terms and conditions contained in the Agreement.
6.5 Please do not use this Withdraw Service if you do not agree with any of the terms and conditions contained in the Agreement.
7. PayPal User Agreements
7.1 In addition to the Agreement, you also agree to abide by the relevant legal agreements for PayPal services governing your relationship with PayPal, including those that may apply specifically to Kenyan PayPal users.
8. PayPal and Equity Bank
7.1 A PayPal account is not a nEquity Bank bank account and we therefore cannot provide you with your PayPal account transaction history.
7.2 We can only provide you with Withdraw Transaction history between your PayPal account and a qualifying Equity Bank bank account.
7.3 All PayPal and PayPal account related queries and complaints must be referred to PayPal directly.
7.4 Queries and complaints concerning the Withdraw Service and Withdraw Transactions must be directed to the Service Centre on +254 763 063000 or be sent to PayPalSupport@equitybank.co.ke
9. Using the Withdraw Service
9.1 To use the Withdraw Service you must have aqualifying Equity Bank bank account.
9.2 The qualifying Equity Bank bank accounts are most Kenya Shillings(KES) transactional bank accounts,United States Dollar (USD), Euro (EUR) and British Pound (GBP) denominated Customer Foreign Currency ("CFC") accounts. Equity Bank Credit cards and Credit card account are not qualifying accounts.
9.3 The Service is available to both individuals and business entities.When transacting on behalf of a business entity, the transactor must be authorised by the business to transact on the nominated business bank account.
9.4 Use of the Withdraw Service is only available and accessible through the website located at selfservice.equitybankgroup.com It is not available through any of our other banking channels.
10. Withdraw Transactions cannot be cancelled or reversed by you
10.1 Withdraw Transactions cannot be reversed or cancelled once confirmed by you and submitted to us.
10.2 If for whatever reason a Withdraw Transaction from your Kenyan PayPal account to your Equity Bank bank account cannot be completed and the funds need to be returned to your Kenyan PayPal account, you will be liable for all related costs, including but not limited to, the SWIFT fee, foreign exchange fluctuations, commissions and any Equity Bank administrative and transaction fees.
10.3It remains your responsibility to ensure that that you comply with all PayPal requirements, to remove any PayPal account limitations and to keep your Kenyan PayPal account in good standing. If your Kenyan PayPal account has been limited by PayPal, for whatever reason, and such a limitation prevents us from successfully completing a Withdraw Transaction, you will be liable for all and any costs referred to in 10.2.
11. Our right to suspend and or reverse a transaction
11.1 We will monitor all Withdraw Transactions concluded in terms of this Withdraw Service and we reserve the right to suspend and/or reverse, at any stage, a Withdraw Transaction in accordance with any legislation and/or upon the directions of a regulatory authority.
11.2 We reserve the right to suspend your access to this Withdraw Service or to terminate your participation in this Withdraw Service:
11.2.1 if you breach any of these terms and conditions;
11.2.2 if you have failed to provide us with any information or documentation required in respect of the Withdraw Service;
11.2.3 if we suspect any fraudulent, illegal or suspicious activity relating to your participation in the Withdraw Service or relating to your Equity Bank or PayPal accounts;
11.2.4 to enable us to comply with any legal or regulatory requirement impacting on the Withdraw Service; or
11.2.5 to comply with a valid court order.
11.3 We will notify you of the suspension or termination immediately to your primary PayPal email address and or your Equity Bank bank account email addresses.
11.4We will not be liable for any damages or losses of any nature resulting our suspension or reversal of a Withdraw Transaction, or the suspension or termination of your access to the Withdraw Services for any of the aforementioned reasons.
12. Fees and charges
12.1 We will charge you a fee when performing Withdraw Transactions, which will be disclosed and quoted to you before requiring you to confirm the transaction.
12.2If payment is made into a KES/EUR/GBP Equity Bank bank account, the payment will be based on the USD/KES/EUR/GBP the Bank’s exchange rate prevailing at the time of effecting the transaction into your equity bank account.
12.3 Your qualifying Equity Bank bank account will be credited with the net amount due to you after all fees have been deducted.
12.4 The fees, charges and exchange rates charged for the Withdraw Service may differ from those which you have negotiated with Equity Bank for any of our other products and services.
13. Reference Number
13.1Whenever you conclude a Withdraw Transaction on the website a communication on the success of the transaction will be sent to you through your email provided to Equity Bank.
13.2 Please quote the aforementioned reference number in all communication with us relating to your Withdraw Transaction, including any queries or disputes.
13.3 We cannot be held liable and you fully indemnify us against all claims, losses, fines, penalties or any other damages of whatsoever nature, including all legal costs on an attorney and own client scale, relating directly or indirectly to any Withdraw Transaction for which you fail to provide us with the corresponding reference number.
14. Timing of transactions
14.1 Withdraw Transactions may take up to a minimum of three (3) business days to reflect in the nominated qualifying Equity Bank bank account.
14.2 Business days exclude all Kenyan, and United States of America’s weekends and public holidays.
15. We may amend this agreement from time totime
15.1 We reserve the right, in our sole discretion, to amend this Agreement at any time and from time to time.
15.2 Any such amendments shall come into effect immediately and automatically.
15.3 We will inform you of any amendments by posting the amended version on our website.
15.4 You agree to review this Agreement whenever you visit the website for any such amendments.
15.5 The use of the Withdraw Service by you will be regarded as an acceptance of the latest version of the Agreement by you.
15.6If you do not agree with the changes to the Agreement you have the right to terminate this Agreement and not to use the Withdraw Service.
16. Disclosure of Personal Information
16.1 To provide the Withdraw Service to you we may be required to disclose your personal or your business information to third parties including but not limited to PayPal.
16.2You consent to and authorise us to disclose your personal information, in the ordinary course of our 17. PayPalPermissions business, to such third parties from time to time and indemnify us PayPal from any liability you may incur associated with or arising from us acting in accordance with this consent.
17. PayPal Permissions
17.1 To use the Withdraw Service you are required to grant us permission to obtain your PayPal account balance from PayPal and you authorise us to make payments on your behalf from your PayPal account to the Equity BankPayPal account, so that we can process the withdraw transaction. During registration selfservice.equitybankgroup.com you will be required to log on to your PayPal account to complete the permissions process.
17.2 As a PayPal account holder, you may have PayPal balances in multiple currencies. We will display all your PayPal account balances to you on selfservice.equitybankgroup.com. You further authorise us to display your PayPal account balance to the required Equity Bank staff for the purpose of providing the Withdraw Service.
17.3 By granting us this permission you indemnify PayPal, and Equity Bank from any liability you may incur associated with or arising from PayPal or us acting in accordance with your permission and authorisation granted.

19.5 We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
19.6 We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

19.8We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.
19.9 You hereby acknowledge that Internet communications and transactions are not 100% secure or error free. In particular, information may not be secure in transit from you to our website. Where you provide particularly sensitive personal information such as passwords, ID numbers, or other sensitive information on this site, it is your responsibility to safeguard them.
19.10 If you believe that any information we are holding on you is incorrect or incomplete, or if you want to restrict the collection or use of your personal information, please email us at PayPalSupport@equitybank.co.ke as soon as possible, so that we can correct any information found to be incorrect.
20. Governing Law
20.1 These Terms and Conditions are governed by the laws of Kenya and any dispute will be subject to the exclusive jurisdiction of the court of Kenya.
